Terms of Use
Terms of Use
Ownership of Site: Agreement to Terms of Use
Effective Date of Terms of Service: June 17, 2026
1. Agreement to These Terms
These Terms of Use ("Terms") govern your access to and use of www.jacquesmariemage.com and any related Jacques Marie Mage sites, applications and services (the "Site"), operated by Jacques Marie Mage, Inc., 927 N. Sycamore Avenue, Los Angeles, California 90038, USA ("Jacques Marie Mage," "we," "us" or "our").
BY USING THE SITE, CREATING AN ACCOUNT OR PLACING AN ORDER, YOU AGREE TO THESE TERMS AND TO OUR PRIVACY POLICY. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SITE. SECTION 19 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED, UNLESS YOU OPT OUT OR THE LAW WHERE YOU LIVE DOES NOT PERMIT IT.
Additional terms apply to certain features, including Pre-Orders (Section 8), Auctions (Section 11) and our text messaging program for SMS, MMS and RCS messages (Section 13), and to purchases, as described in our Shipping and Returns policies, which form part of these Terms. Where those specific terms conflict with these general Terms, the specific terms control for that feature.
2. Changes to These Terms
We may update these Terms from time to time. The version in effect is posted on this page with its effective date. If we make a material change, we will notify you through the Site or by email before it takes effect. Changes apply to your use of the Site after the effective date and never apply retroactively to orders placed, pre-orders made or bids submitted before that date.
3. Eligibility & Accounts
You must be at least 18 years old, or the age of majority where you live, to make a purchase, place a pre-order or create an account. Participation in Auctions requires additional eligibility, set out in Section 11.
You are responsible for keeping your account credentials confidential and for activity under your account that results from your failure to do so. Please notify us promptly at shop@jacquesmariemage.com if you suspect unauthorized use. You may not use another person's account without their permission, or maintain multiple accounts to get around purchase limits, queue positions or bidding limits.
You may close your account at any time. Closing your account does not cancel open orders, pre-orders or Auction obligations.
4. Content & Intellectual Property
All text, images, photography, video, audio, designs, trademarks, logos, trade dress, software and other materials on the Site, and their selection and arrangement (collectively, "Content"), are owned by or licensed to Jacques Marie Mage and are protected by intellectual property and unfair competition laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Site for your personal, non-commercial use. Except as expressly permitted, you may not copy, reproduce, republish, mirror, distribute, translate, modify or create derivative works from any Content without our prior written consent. Materials we make available for download may be used for personal informational purposes only, without removing any proprietary notices.
You may not use the Content, including product imagery and descriptions, to train, fine-tune or develop any artificial intelligence or machine-learning model, or to build a dataset, without our prior written consent.
5. Use of the Site
You agree not to:
- use bots, scrapers, spiders, automated checkout tools or similar methods, or equivalent manual processes, to access, copy, monitor or purchase from the Site, including to secure pre-order queue positions, limited releases or Auction bids;
- attempt to gain unauthorized access to the Site, accounts or connected systems, or probe, scan or test their vulnerability;
- interfere with the Site's operation, place an unreasonable load on its infrastructure, or disrupt any transaction or another person's use of the Site;
- impersonate any person, misrepresent your affiliation, or disguise the origin of any communication;
- attempt to identify or trace any other user or customer, or collect information about them;
- use the Site for any unlawful, fraudulent or infringing purpose.
We may block or limit any activity we reasonably believe violates this section.
6. Products, Pricing & Availability
Our pieces are produced in limited, serialized quantities and many are handcrafted. Natural variations in color, texture, finish and grain are characteristic of the work and are not defects. Product images are representative and may differ from the piece you receive due to lighting, photography and screen settings.
All products are subject to availability. Displaying a product on the Site, or adding it to your cart, does not reserve it. We may change products, descriptions and prices at any time, but price changes do not affect orders or pre-orders already placed, except as described below for errors.
We work to ensure prices and descriptions are accurate. If we discover a clear pricing or description error affecting your order, we will contact you before shipping and give you the option to proceed at the correct price or cancel for a full refund.
Purchase limits & resale
So that as many clients as possible have the opportunity to acquire our work, we may limit quantities per person, household, account, payment method or address. Our products are sold for personal use only. We may decline or cancel orders, pre-orders or bids that we reasonably believe are placed for resale or commercial purposes or that circumvent purchase limits, and we will refund any amount paid for a cancelled order.
7. Orders & Payment
When you place an order, you are making an offer to purchase. The order confirmation email we send acknowledges that we have received your order; it is not an acceptance. A contract for the sale of in-stock items is formed when we send you a shipping confirmation. Before that point, we may decline or cancel an order, in whole or in part, including for suspected fraud, verification issues, purchase-limit violations, pricing errors or lack of availability. If we cancel, we will refund all amounts charged for the cancelled items within seven (7) days.
By submitting payment information, you authorize us and our third-party payment processors to charge your selected payment method for the order total, including applicable taxes, duties and shipping. You represent that you are authorized to use that payment method. Payments are also subject to the processor's terms and the terms of your card issuer or payment provider. Your bank may require additional authentication (such as a one-time code) to complete a payment.
Prices are shown in the currency you select. Where duties and import taxes are shown at checkout, they are included in your total. Otherwise, you are responsible for any duties, taxes or fees charged by the destination country on delivery.
Refunds are always issued to your original payment method, in the original amount charged, unless you request otherwise in writing. We are not responsible for exchange-rate differences or fees charged by your bank.
8. Pre-Orders
In short: a pre-order holds your place in line to purchase a piece once it arrives. It is not a guarantee that you will receive it. Allocation is first come, first served. If we cannot fulfill your pre-order because of availability, every amount you paid is refunded in full.
8.1 What a pre-order is
Certain pieces may be offered for pre-order before they are in stock. When you place a pre-order, you are reserving a position in the allocation queue for that piece. A pre-order is a request to purchase the piece when it becomes available; it is not a confirmed sale, and placing a pre-order and paying for it does not guarantee that you will receive the piece.
8.2 Payment at the time of pre-order
The full purchase price, plus applicable taxes and shipping, is charged when you place your pre-order. This payment secures your position in the queue. It is not our acceptance of your order. A contract for the sale of a pre-ordered piece is formed only when we send you a shipping confirmation for that piece.
8.3 First come, first served
Pre-orders are allocated in the order in which they are successfully completed, meaning payment has been authorized and captured, as recorded by our systems. Your position is determined by that timestamp. A pre-order may lose its position, or be cancelled and refunded, if payment fails or is reversed, if we cannot verify your identity, address or payment details, or if the pre-order violates Section 5 or our purchase limits in Section 6. Queue positions cannot be transferred, sold or assigned.
8.4 Allocation is not guaranteed
Production of our pieces is limited, and final quantities may be lower than anticipated because of handcrafted production, materials, quality control or other factors. If allocation for a piece is exhausted before your position in the queue is reached, your pre-order will be cancelled and refunded as described in 8.5. We will notify you by email.
8.5 Full refund if we cannot fulfill
If we are unable to fulfill your pre-order for any reason related to availability, or we otherwise cancel it, we will refund 100% of the amounts you paid for that pre-order, including the product price, taxes, shipping and any prepaid duties, to your original payment method within seven (7) days of cancellation. Your bank or card issuer may take additional time to post the credit to your account. Refunds are made in money to your original payment method and are never substituted with store credit, vouchers or gift cards unless you expressly request it.
8.6 Estimated dates & delays
Each pre-order product page displays an anticipated shipping date. This date is our good-faith estimate based on information available when the pre-order opens. If we will not be able to ship by that date, or within 30 days of your pre-order if no date was stated, we will notify you by email before that date with a revised shipping date (or let you know if we cannot yet provide one) and the reason for the delay, and you may choose to:
- keep your pre-order and your position in the queue, or
- cancel your pre-order for a full refund, at no cost to you.
If the revised date is 30 days or less after the original date and you do not respond, your pre-order will remain active. If we cannot provide a revised date and you choose to keep your pre-order, you may still cancel at any time before shipment. If we are unable to meet a revised date, we will contact you again, and your pre-order will be cancelled and refunded unless you expressly confirm that you wish to keep it.
8.7 Cancelling your pre-order
You may cancel a pre-order at any time before we send your shipping confirmation by contacting shop@jacquesmariemage.com, and you will receive a full refund under 8.5. Cancelling forfeits your position in the queue. Once a pre-ordered piece ships, our Returns policy applies.
8.8 Price & product details
The price you pay at the time of pre-order is the price of your piece; it will not increase if the published price later changes. Pre-order imagery may depict a prototype, and minor variations in the final production piece are consistent with handcrafted work. If a material change is made to the piece, such as its frame material, lens or colorway, we will notify you and you may cancel for a full refund.
9. Shipping, Title & Risk of Loss
Shipping methods, dispatch times and delivery requirements are described in our Shipping policy. Every order requires an adult signature upon receipt. Title to products passes to you when the shipment is handed to the carrier. Risk of loss passes to you upon delivery to the shipping address you provide. Please direct orders to a secure location.
Delivery dates are estimates. Delays caused by circumstances beyond our reasonable control, such as weather, carrier disruptions or customs, may occur. This does not limit your rights regarding pre-order delays under Section 8.6.
10. Returns & Cancellations
Returns and exchanges are governed by our Returns policy. Auction purchases are subject to Section 11.8. Bespoke and prescription pieces made to your specifications may not be returned except where defective or not as described, to the extent permitted by law.
If you reside in the European Economic Area, the United Kingdom or Switzerland, you have a 14-day right to cancel your purchase, described in our European Terms.
11. Auctions
We may from time to time offer certain pieces through competitive online bidding (each, an "Auction"). This Section supplements the rest of these Terms and controls for Auction activity in the event of a conflict.
11.1 Eligibility
To participate, you must have an active Jacques Marie Mage account in good standing, be at least 18 years old, have a valid payment method on file, and not be subject to an Auction suspension. We may limit Auctions to particular client tiers or regions and may require identity verification before you bid.
11.2 Payment authorization
By registering for an Auction, you authorize us or our payment processor to place a temporary pre-authorization hold on your payment method of up to your maximum bid, or another amount disclosed to you when you register. Holds are released by your bank if you do not win, typically within several business days. You agree to keep a valid payment method on file throughout the Auction. If you win, you authorize us to charge your payment method for the winning bid plus applicable taxes, duties and shipping. You agree to complete any authentication your bank requires to approve that charge.
11.3 Bids
Each bid is a binding offer to purchase the piece at the bid amount and cannot be retracted or modified once submitted, except where the law provides otherwise. Please review each bid carefully before submitting. Placing a bid does not guarantee you will win. Shill bidding, bid manipulation, collusion or any artificial inflation of bids is prohibited.
11.4 Winning bid
The highest valid bid at Auction close wins, subject to these Terms. The winning bidder is notified by email within 24 hours of close, and the contract for sale is formed at that point. If the winning payment fails, you will have a 48-hour cure period to provide a valid alternative payment method.
11.5 Purchase default
A "Purchase Default" occurs if a winning bidder (a) does not complete payment within the cure period, (b) files a chargeback or payment dispute on a winning-bid transaction without first contacting us to resolve it, (c) provides false or fraudulent payment information, or (d) otherwise fails to complete the purchase. On a Purchase Default, we may suspend or revoke Auction eligibility as set out in 11.6, offer the piece to the next-highest bidder or relist it, and, to the extent permitted by law, seek recovery of our actual losses resulting from the default. Exercising a legal right of withdrawal or cancellation, or disputing a charge in good faith, is never a Purchase Default.
11.6 Auction suspension
We may suspend or revoke Auction eligibility for a Purchase Default, a pattern of bidding without intent to purchase, bid manipulation, use of multiple accounts, bad-faith chargebacks, or other conduct that harms the integrity of our Auctions. Generally: a first Purchase Default results in a 90-day suspension; a second within 24 months results in a 12-month suspension; a third, or any bid manipulation or fraud, results in a permanent ban. You may contact us to request a review of any suspension.
11.7 Cancellation, errors & extension
We may cancel, suspend, extend or restart an Auction, or void affected bids, in the event of technical errors, system failures, suspected fraud or manipulation, or other operational issues. If an Auction is cancelled before it closes, all bids are void and no purchase obligation arises. If a bid is placed within the final 30 seconds of an Auction, the end time is extended by 2 minutes, and this repeats until no bid is placed in the final 30 seconds.
11.8 Returns & condition
Auction sales are final except where the piece received is materially different from its listing or arrives with a manufacturing defect, and subject to any statutory rights that apply to you. Claims must be submitted in writing within 7 days of delivery. Auction pieces may include vintage, limited-edition or collectible items that show natural wear, patina or minor imperfections consistent with their description and images; these do not constitute defects.
12. Privacy & Your Data
Our Privacy Policy explains how we collect, use, share and retain personal information, including through cookies and similar technologies, and how to exercise your privacy rights. Depending on where you live, you may have the right to access, correct, delete or port your personal information, to opt out of targeted advertising or the "sale" or "sharing" of personal information as defined by applicable law, and to withdraw consent. You can manage cookie and advertising choices through the Cookie Preferences link in the Site footer, and we honor recognized opt-out preference signals, such as Global Privacy Control, where required by law. We will not discriminate against you for exercising your privacy rights.
We use personal information you provide during pre-orders and Auctions, such as order timestamps, payment authorization status and bidding history, to administer queues and Auctions, prevent fraud and enforce these Terms, as described in our Privacy Policy.
13. Communications & Text Messages
Text message program summary: By opting in you agree to receive recurring automated promotional and personalized marketing text messages from Jacques Marie Mage at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Consent is not a condition of purchase. Messages may be delivered as SMS, MMS or RCS (Rich Communication Services) messages.
13.1 Electronic communications
You agree that we may provide notices, disclosures and other communications about your account, orders, pre-orders and Auctions electronically, including by email and on the Site, and that these satisfy any legal requirement that they be in writing.
13.2 Marketing emails
Marketing emails are sent only in accordance with your preferences and applicable law. You may unsubscribe at any time using the link in any marketing email or by contacting us.
13.3 Our text message program
Jacques Marie Mage offers an optional text messaging program (the "Text Program"), delivered as SMS, MMS or RCS (Rich Communication Services) messages depending on your device and carrier. RCS messages may appear from our verified Jacques Marie Mage business profile and can include images, video, buttons and suggested replies. In this Section, "texts" and "text messages" include SMS, MMS and RCS messages. Marketing texts may include new collection and release announcements, pre-order and Auction openings, gallery and event invitations, Virtual Concierge outreach, offers and other promotional content. Separately, if you request them, we may send transactional texts about your account, orders, pre-orders, shipments, Auctions and Client Services conversations. This Section 13 applies to both.
13.4 Your consent
By opting in to the Text Program, whether at checkout, through a form on the Site, by texting a keyword to us or by any other method we offer, you expressly consent to receive recurring automated promotional and personalized marketing text messages (including SMS, MMS and RCS messages) from Jacques Marie Mage at the mobile number you provide, including messages sent using automated technology. Consent is not a condition of any purchase. You represent that you are at least 18 years old and that you are the account holder or regular user of the mobile number you provide, and you agree to tell us promptly if that changes.
13.5 Frequency, cost & timing
Message frequency varies and depends on releases, pre-orders, Auctions and your activity. Message and data rates may apply according to your mobile plan, and you are responsible for any charges from your carrier. We will not send marketing texts before 8 a.m. or after 8 p.m. in your local time, as determined by your area code or address, and we comply with any additional limits on timing or frequency that apply where you live.
13.6 How to opt out
You may stop receiving texts at any time by replying STOP to any message. Replies such as END, CANCEL, UNSUBSCRIBE, QUIT, REVOKE or OPT OUT also work, as does telling us in any other reasonable way, including by email to shop@jacquesmariemage.com or by calling (877) 358-6161. After you opt out, we may send one final text confirming your request, and we will stop texting you within the time required by law. To stop transactional texts as well as marketing texts, reply STOPALL or tell us that you want all texts to stop. You may rejoin at any time by texting START or by opting in again through the Site.
13.7 Help
Reply HELP to any message for assistance, or contact Client Services at shop@jacquesmariemage.com or (877) 358-6161.
13.8 Carriers & delivery
Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device and is not guaranteed. We do not rely on texts as the only notice of anything time-sensitive about your order, pre-order or Auction; that information is also sent by email or shown in your account. The Text Program is currently offered to U.S. mobile numbers. Where we offer texts in another country, the consent and opt-out rules of that country apply.
13.9 Changing or giving up your number
If you change, deactivate, transfer or give up your mobile number, please reply STOP from that number first or let us know, so that messages are not sent to the new holder of that number.
13.10 Privacy & security
We use your mobile number and messaging data as described in our Privacy Policy. Text messaging originator opt-in data and consent will not be sold, rented, or shared with any third parties for marketing or promotional purposes. We also do not sell, rent or share your mobile number with any third party or affiliate for their marketing or promotional purposes. We share this information only with service providers that help us operate the Text Program, such as our messaging platform and mobile carriers, and as required by law. Our texts will never ask you for a password or full payment card details. Please do not send those, or other sensitive personal information, by text.
13.11 Changes & disputes
We may change, suspend or end the Text Program, or any keyword or number used for it, at any time, and we will let subscribers know of any material change. Any dispute relating to texts we send or the Text Program, including claims under the Telephone Consumer Protection Act or similar state laws, is subject to Section 19 (Dispute Resolution & Arbitration), to the extent permitted by law.
14. Third-Party Sites & Services
The Site may link to or integrate third-party websites and services, such as payment processors, carriers and social platforms. We do not control and are not responsible for their content, terms or privacy practices. Your use of them is governed by their own terms.
15. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, WITH RESPECT TO THE SITE. THIS DISCLAIMER DOES NOT LIMIT ANY WARRANTY THAT APPLIES TO PRODUCTS YOU PURCHASE, OR ANY STATUTORY CONSUMER GUARANTEE THAT CANNOT BE EXCLUDED UNDER THE LAW WHERE YOU LIVE.
We may modify, suspend or discontinue all or part of the Site, including for maintenance, at any time.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JACQUES MARIE MAGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM, OR (B) US$100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Jacques Marie Mage and its affiliates, officers, directors, employees and agents from third-party claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site.
18. Suspension & Termination
We may, acting reasonably and in good faith, suspend or terminate your access to the Site or your account if you violate these Terms, if required by law or a governmental request, if you request account deletion, or if we discontinue or materially change the Site. Where practical, we will give you notice and the reason. Termination does not affect orders already shipped, and any open order or pre-order we cancel as a result will be refunded, except where we have a legal right to withhold amounts due to fraud.
We may preserve and disclose information about your use of the Site where we reasonably believe it is necessary to comply with law or legal process, enforce these Terms, respond to claims, prevent fraud, or protect the rights, property or safety of Jacques Marie Mage, our clients or others, as further described in our Privacy Policy.
19. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND LIMITS YOUR ABILITY TO BRING A CLASS ACTION. IT DOES NOT APPLY TO CONSUMERS RESIDING IN THE EEA, THE UK OR SWITZERLAND, WHOSE DISPUTES ARE GOVERNED BY OUR EUROPEAN TERMS, OR IN ANY OTHER JURISDICTION WHERE SUCH TERMS ARE NOT ENFORCEABLE AGAINST CONSUMERS.
19.1 Informal resolution first
Before starting a formal proceeding, you and we agree to try to resolve any dispute informally. Send a written notice describing the dispute and the relief sought to shop@jacquesmariemage.com, or by mail to our address in Section 24. If the dispute is not resolved within 60 days of receipt of the notice, either party may proceed under 19.2.
19.2 Binding individual arbitration
Any dispute, claim or controversy arising out of or relating to these Terms, the Site, your purchases, pre-orders or Auction participation will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration may be conducted by video, by phone, by written submission or in the county where you reside. Fees will be allocated as provided in the AAA Consumer Arbitration Rules, and we will pay any fees those rules require the business to pay. The arbitrator may award the same individual relief a court could award.
19.3 Exceptions
Either party may bring an individual claim in small claims court if it qualifies. Either party may seek injunctive relief in court for infringement or misuse of intellectual property. Nothing in this section waives your right to seek public injunctive relief where that right cannot be waived under applicable law; any such claim will be decided in court after the individual arbitration is complete.
19.4 Class action and jury waiver
YOU AND JACQUES MARIE MAGE EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.
19.5 Mass arbitration
If 25 or more similar arbitration demands are filed by or with the coordination of the same counsel, the AAA's mass arbitration procedures will apply, and the demands may be administered in batches.
19.6 Your right to opt out
You may opt out of this arbitration agreement by emailing shop@jacquesmariemage.com with your name, the email address on your account and a statement that you opt out of arbitration, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
19.7 Severability
If the class action waiver is found unenforceable as to any claim, that claim will proceed in court and not in arbitration. If any other part of this section is found unenforceable, the rest will remain in effect.
20. Governing Law & Venue
These Terms are governed by the laws of the State of California and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-laws principles. Subject to Section 19, any claim that proceeds in court will be brought in the state or federal courts located in Los Angeles County, California, and you and we consent to their jurisdiction.
21. International Clients
These Terms apply to clients in the United States and all regions outside the European Economic Area, the United Kingdom and Switzerland. If you reside in, or your order is delivered to, one of those countries, our European Terms apply to you instead, whichever version of this page your browser displays.
The Site is operated from Los Angeles, California. Not all products, features, pre-orders or Auctions are available in every country, and any offer is void where prohibited. You are responsible for complying with local laws, including import and export rules. If you are a consumer residing outside the United States, including in Canada (including Québec) or Australia, nothing in these Terms limits mandatory consumer protections under the law of your country of residence, and you may bring proceedings in the courts of your country of residence where that law allows. Where a provision of these Terms conflicts with such mandatory law, that law prevails to the extent of the conflict.
22. Accessibility
We are committed to making the Site accessible to all clients, including people with disabilities, and we work toward conformance with recognized accessibility standards such as WCAG 2.2 Level AA. If you have difficulty using any part of the Site, please contact us at shop@jacquesmariemage.com or (877) 358-6161 and we will assist you, including by helping you complete a purchase or pre-order.
23. General Terms
These Terms, together with the policies referenced in them, are the entire agreement between you and Jacques Marie Mage regarding the Site, and supersede prior understandings. If any provision is held unenforceable, it will be limited to the minimum extent necessary and the remainder will stay in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets, provided your rights are not reduced. Neither party is liable for delays caused by events beyond its reasonable control, except that this does not limit your right to a refund for orders or pre-orders we do not fulfill. These Terms do not confer rights on any third party. Headings and summaries are for convenience only. If these Terms are translated, the English version controls to the extent permitted by law.

Effective November 1, 2026
Terms for clients in the European Economic Area, the United Kingdom and Switzerland. Clients in the United States and other regions: view those Terms.
By using the Site, creating an account or placing an order, you agree to these Terms. Please also read our Privacy Policy. Nothing in these Terms limits the rights you have as a consumer under the law of your country of residence.
Additional terms apply to certain features, including Pre-Orders (Section 8), Auctions (Section 11) and our text messaging program for SMS, MMS and RCS messages (Section 13), and to purchases, as described in our Shipping and Returns policies, which form part of these Terms. Where those specific terms conflict with these general Terms, the specific terms control for that feature, unless the conflicting term is less favorable to you than these Terms.
- use bots, scrapers, spiders, automated checkout tools or similar methods, or equivalent manual processes, to access, copy, monitor or purchase from the Site, including to secure pre-order queue positions, limited releases or Auction bids;
- attempt to gain unauthorized access to the Site, accounts or connected systems, or probe, scan or test their vulnerability;
- interfere with the Site's operation, place an unreasonable load on its infrastructure, or disrupt any transaction or another person's use of the Site;
- impersonate any person, misrepresent your affiliation, or disguise the origin of any communication;
- attempt to identify or trace any other user or customer, or collect information about them;
- use the Site for any unlawful, fraudulent or infringing purpose.
The total price of your order, including VAT, any import duties and delivery charges, is shown before you place it. If duties for your destination are not collected at checkout, this is stated at checkout and they will be collected by the carrier on delivery.
If we will not be able to ship by that date, we will notify you by email before that date with a revised date and the reason for the delay. You may then keep your pre-order and your position in the queue, or cancel it for a full refund at no cost. If we are unable to meet a revised date, your pre-order will be cancelled and refunded unless you expressly confirm that you wish to keep it.
8.7 Cancelling your pre-order
You may cancel a pre-order at any time before we send your shipping confirmation, using the Withdraw from contract here function or by contacting shop@jacquesmariemage.com, and you will receive a full refund under 8.5. Cancelling forfeits your position in the queue. Once a pre-ordered piece is delivered, you also have the 14-day right to cancel described in Section 10.
9. Delivery & Risk of Loss
Shipping methods, dispatch times and delivery requirements are described in our Shipping policy. Every order requires an adult signature upon receipt. Risk of loss passes to you when you, or a person you designate (other than the carrier), take physical possession of the order. Please direct orders to a secure location.
Delivery dates are estimates. Delays caused by circumstances beyond our reasonable control, such as weather, carrier disruptions or customs, may occur. This does not limit your rights regarding pre-order delays under Section 8.6 or your rights under Section 10.
10. Your 14-Day Right to Cancel
In short: you may cancel any order, pre-order or Auction purchase within 14 days of receiving it, without giving a reason, and receive a full refund.
10.1 Your right to cancel
You have the right to withdraw from your contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. If one order is delivered in several shipments, the period expires 14 days after you receive the last item. This right applies to standard orders, pre-orders and purchases made through Auctions on the Site.
10.2 How to cancel
To exercise the right of withdrawal, use the Withdraw from contract here function, available in your account and at the foot of every page, or inform us of your decision by an unequivocal statement sent by email to shop@jacquesmariemage.com or by post to Jacques Marie Mage, Inc., 927 N. Sycamore Avenue, Los Angeles, California 90038, USA. You may use the model withdrawal form in 10.6, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period has expired. We will confirm receipt of your withdrawal by email without delay.
10.3 Refunds
If you withdraw, we will reimburse all payments received from you, including the costs of standard delivery, without undue delay and in any event no later than 14 days from the day we are informed of your decision. We do not refund the additional cost of any express or overnight delivery you selected over our least expensive standard delivery. We will use the same means of payment you used for the original transaction, unless you expressly agree otherwise, and you will not incur any fees as a result. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.
10.4 Returning the goods
You must send back the goods, with their case, serialization card and original packaging where possible, to the address we provide when you withdraw, without undue delay and in any event no later than 14 days from the day you notify us. The deadline is met if you send the goods before the 14 days have expired. You bear the direct cost of returning the goods, unless we provide you with a prepaid return label. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning, in the way you could examine them in a shop.
10.5 Exceptions
The right of withdrawal does not apply to goods made to your specifications or clearly personalized, including prescription lenses and bespoke commissions.
10.6 Model withdrawal form
To: Jacques Marie Mage, Inc., 927 N. Sycamore Avenue, Los Angeles, California 90038, USA, shop@jacquesmariemage.com
I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale of the following goods:
Ordered on (*) / received on (*):
Order number:
Name of consumer(s):
Address of consumer(s):
Signature of consumer(s) (only if this form is sent on paper):
Date:(*) Delete as appropriate.
10.7 Legal guarantee
In addition to your right to cancel, you benefit from the statutory legal guarantee of conformity under the consumer law of your country of residence, under which we are responsible for any lack of conformity that becomes apparent within the period set by that law (in the EU, at least two years from delivery). In the United Kingdom, your rights under the Consumer Rights Act 2015 include repair, replacement or a refund for goods that are faulty or not as described. Our Returns policy applies in addition to, and never limits, these rights.
10.8 Switzerland
Swiss law does not provide a statutory right of withdrawal for online purchases. We nonetheless extend the 14-day right to cancel in this Section 10 to consumers in Switzerland on the same terms.
11.3 Bids
Each bid is a binding offer to purchase the piece at the bid amount and cannot be retracted or modified once submitted. If you win, your 14-day right to cancel under Section 10 still applies once the piece is delivered.
Auction purchases may be cancelled within 14 days of delivery under Section 10, and your legal guarantee rights apply in full. Auction pieces may include vintage, limited-edition or collectible items that show natural wear, patina or minor imperfections consistent with their description and images; these do not constitute defects.
12. Privacy & Your Data
Jacques Marie Mage, Inc. is the controller of your personal data. Our Privacy Policy explains how we collect, use, share, transfer and retain personal data, the legal bases we rely on, and how long we keep it. Under the GDPR, the UK GDPR and the Swiss Federal Act on Data Protection, you have the right to access, rectify, erase, restrict or port your personal data, to object to processing (including for direct marketing), to withdraw consent at any time, and to lodge a complaint with your local data protection authority.
Non-essential cookies, including analytics and advertising cookies, are used only with your consent, which you can give, refuse or withdraw at any time through the Cookie Preferences link in the Site footer.
We use personal data you provide during pre-orders and Auctions, such as order timestamps, payment authorization status and bidding history, to administer queues and Auctions, prevent fraud and enforce these Terms, as described in our Privacy Policy.

13.1 Electronic communications
You agree that we may provide notices, disclosures and other communications about your account, orders, pre-orders and Auctions electronically, including by email and on the Site, and that these satisfy any legal requirement that they be in writing.
13.2 Marketing emails
We send marketing emails only where you have consented or where the law otherwise permits. You may unsubscribe at any time using the link in any marketing email or by contacting us, free of charge.
13.3 Our text message program
Where it is offered in your country, Jacques Marie Mage operates an optional text messaging program (the "Text Program"), delivered as SMS, MMS or RCS (Rich Communication Services) messages depending on your device and operator. In this Section, "texts" include SMS, MMS and RCS messages. Marketing texts may include new collection and release announcements, pre-order and Auction openings, gallery and event invitations, Virtual Concierge outreach and offers. If you request them, we may also send service texts about your account, orders, pre-orders, deliveries and Auctions.
13.4 Your consent
We send promotional and personalized marketing texts (including SMS, MMS and RCS messages) only if you have given your specific, informed consent, for example by ticking an unticked box at checkout or on a Site form. Consent is never a condition of purchase. By opting in, you confirm that you are at least 18 years old and that you are the account holder or regular user of the mobile number you provide.
13.5 Frequency & cost
Message frequency varies. We do not charge for our texts, but your mobile operator's standard message and data rates, including roaming charges, may apply.
13.6 Withdrawing consent
You may withdraw your consent at any time, free of charge and without giving a reason, by replying STOP to any message, by contacting us at shop@jacquesmariemage.com or (877) 358-6161, or by updating your preferences in your account. Withdrawing consent does not affect the lawfulness of texts sent before you withdrew it. We may send one text confirming your request. Reply HELP to any message for assistance.
13.7 Delivery & your number
Delivery of texts depends on your mobile operator and device and is not guaranteed. Information about your order is also sent by email or shown in your account. If you change or give up your mobile number, please reply STOP from that number first or let us know.
13.8 Your data
We process your mobile number and messaging data on the basis of your consent (for marketing texts) or to perform our contract with you (for service texts), as described in our Privacy Policy. Text messaging originator opt-in data and consent will not be sold, rented, or shared with any third parties for marketing or promotional purposes. We do not sell, rent or share your mobile number with third parties for their marketing or promotional purposes. We share it only with service providers that operate the Text Program for us, such as our messaging platform and mobile operators, under appropriate safeguards, including for transfers outside your country. Our texts will never ask for a password or payment card details.
14. Third-Party Sites & Services
The Site may link to or integrate third-party websites and services, such as payment processors, carriers and social platforms. We do not control and are not responsible for their content, terms or privacy practices. Your use of them is governed by their own terms.
15. Site Availability
We work to keep the Site available and its information accurate, but we cannot guarantee that the Site will always be uninterrupted or error-free. We may modify, suspend or discontinue all or part of the Site, including for maintenance. Nothing in this Section affects the legal guarantee of conformity for products you purchase or any other right you have as a consumer.
16. Our Responsibility to You
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen. We are not responsible for loss or damage that is not foreseeable, or for business losses, as our products are sold for personal use.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional or grossly negligent conduct, for breach of your statutory consumer rights, or for any other liability that cannot be excluded or limited under the law of your country of residence.
17. Your Responsibility
If you breach these Terms or misuse the Site, you are responsible, to the extent permitted by law, for losses we suffer as a foreseeable result of that breach, including third-party claims, insofar as you are at fault.
19. Complaints & Disputes
If something has gone wrong, please contact our Client Services team at shop@jacquesmariemage.com or (877) 358-6161. We aim to respond to every complaint within five business days and to resolve it as quickly as possible.
We are not obliged to participate, and do not commit to participating, in dispute resolution proceedings before a consumer arbitration or alternative dispute resolution body. For cross-border purchases within the EU, Iceland and Norway, you may obtain free advice from the European Consumer Centres Network (ECC-Net).
No arbitration agreement or class action waiver applies to you. You may bring any claim before the courts of your country of residence, and we will only bring claims against you in those courts.
20. Governing Law
These Terms are governed by the laws of the State of California. However, if you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you habitually reside, and you may enforce your consumer rights in the courts of that country.
21. Who These Terms Apply To
These European Terms apply to consumers who reside in the European Economic Area, the United Kingdom or Switzerland, or whose order is delivered to one of those countries. They apply whichever version of this page your browser displays. All other clients are covered by our Terms for the United States and other regions.
The Site is operated from Los Angeles, California. Not all products, features, pre-orders or Auctions are available in every country. You are responsible for complying with local laws, including import rules.
